Kvirkel is a software-as-a-service (SaaS) application that provides secure photo backup and cloud synchronization services for iOS devices. The Service may include features such as automatic uploads, storage management, and data restoration.

Use of the Service requires:

• A compatible device and email address; and
• An active Kvirkel subscription purchased through the Apple App Store.

3. User Accounts

Access to Kvirkel may require authentication through your email address. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

You must be at least 13 years old (or the minimum age required by local law) to use the Service.

4. Subscriptions and Payments

Kvirkel is offered as a recurring subscription service. All subscriptions, billing, and renewals are handled through the App Store of the respective platform platform.

• Subscriptions automatically renew unless cancelled before the end of the current period.
• You can manage or cancel your subscription at any time through your Apple App Store settings.

5. Data Storage and Backups

The Service allows you to back up and store your photos securely in the cloud. We strive to maintain reliable and continuous service; however, we do not guarantee that your data will be permanently stored or retrievable in all circumstances (for example, in case of technical failures, or account termination).

Users are responsible for ensuring they have additional backups of important data.

6. Acceptable Use

You agree not to use Kvirkel to:

• Violate any laws or regulations;
• Upload or share illegal, harmful, or infringing content;
• Reverse-engineer, modify, or interfere with the operation of the app; or
• Circumvent any technical limitations or security features.

We reserve the right to suspend or terminate your access if we believe your use violates these Terms.

7. Intellectual Property

All intellectual property rights in Kvirkel, including trademarks, logos, software, and design, are owned by Gustav Westling AB or its licensors.

You retain ownership of any photos or content you upload, but you grant us a limited, non-exclusive license to store, process, and back up that content as necessary to provide the Service.

8. Termination

You may terminate your use of Kvirkel at any time by cancelling your subscription through your Apple ID account.

We may suspend or terminate your access to the Service if you violate these Terms or engage in fraudulent or abusive activity.

Upon termination, your access to backups and stored data may be permanently deleted.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data stored will remain accessible without loss.

10. Limitation of Liability

To the maximum extent permitted by law, Gustav Westling AB shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, revenue, or profits arising from the use of Kvirkel.

Our total liability for any claim relating to the Service shall not exceed the amount paid by you for the subscription during the three (3) months preceding the claim.

11. Changes to These Terms

We may update or modify these Terms at any time. Material changes will be communicated through the app, on our website, or via your registered contact information.

Your continued use of the Service after such updates constitutes your acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles.

Any disputes shall be resolved by the Stockholm District Court (Stockholms tingsrätt), unless otherwise required by mandatory consumer protection law.
